Bullying in the workplace is increasingly being recognized as a big problem. A survey by the TUC in 2006 estimated that up to 5 million people could be victims of bullying at work, a further survey by Unison found that 83% of the bullying cases came from the victim’s manager. This is hardly surprising as people are unwilling to speak out against harassment by their boss for fear of losing their job.

It appears that people are generally aware that if you are bullied because of your sex, age, race or disability that you can take action against the bully and/or your employers. However under the Harassment Act 1997, you can claim compensation from your employers for harassment of any kind if it happens more than once, if severe enough to cause you significant distress and your employer's fail to stop it happening and it is severe enough to comprise of at least two criminal events.

Many people complain to their employers about the treatment they receive from colleagues or their boss but their employers fail to take any steps to stop the harassment. Also if your boss is the person who is bullying you it is difficult to complain to anyone or see a way of stopping the bullying other than leaving your job.

Being forced to leave your job could mean you lose out financially, either by taking a job for less money or losing out on benefits or pension that you would have been entitled to if you stayed. These losses can be included in your claim.

It is sometimes difficult to see that you are being bullied or you may not initially be willing to believe it. This has previously caused problems for some people who have been bullied as you only have 3 months to bring a claim in an Employment Tribunal. However, under the harassment law you have six years to make a claim for compensation.
