Court of Protection/ Fund Administration
If a loved one has already lost mental capacity and is therefore unable to manage their own affairs it is necessary for a relative, friend, or professional advisor to apply to the Court of Protection for the appointment of a Deputy.
A Deputy is a person appointed by the Court of Protection to deal with the financial affairs of a person who is unable to do so for himself.
The application process usually takes several months to complete and can be a daunting task. KPSolicitors have approachable and experienced solicitors who are able to assist you in your application or deal with the application in its entirety for you.
A Deputy should be willing and able to devote time to the financial affairs of another person on a regular basis.
The Court of Protection will require annual accounts to be delivered after the appointment of the Deputy and we are able to offer support, assistance or a full administration service if required.
KPSolicitors acting as Deputy
If a close relative needs considerable emotional support you may wish to use a professional Deputy to take care of the financial side, leaving the family to concentrate on caring for your loved one.
There are cases where there is no one suitable to act as Deputy or no one willing to take on the duties of a Deputy. In these circumstances, it may be appropriate for a professional to apply for a Deputyship.
KPSolictors can take the load off your shoulders. Our Private Client Department is experienced in dealing with all aspects of Court of Protection work and would be happy to discuss the possibility of acting on your behalf as a professional Deputy.
The appointed Deputy has many responsibilities and duties, these some of the many tasks which need to be undertaken:-
- Payment of day-to-day bills and invoices
- Dealing with correspondence from the Public Guardianship Office and the Court of Protection
- Preparation and submission of Annual Accounts
- Preparation and submission of Annual Tax Returns
- Seeking the approval of the Public Guardianship Office on expenditure
applying for benefits - Regular liaison with all parties involved
- Our experience has shown that family members would rather devote their time to caring for their loved one rather than taking on the burden of looking after their finances.
- We can deal with clients throughout the UK and are more than happy to assist any client wherever their location.
