Prior to the 1st October 2007 it was possible to make an Enduring Power of Attorney to appoint one or more people to help manage your financial affairs. Since the change in the Law, it is no longer possible to create a new Enduring Power of Attorney nor is it possible to make changes to an existing Enduring Power of Attorney which is already in place. Enduring Power of Attorney solicitors can make these often complex and confusing matters less stressful for you.
If you have made an Enduring Power of Attorney (either with or without the help of enduring power of attorney Solicitors) prior to the 1st October 2007 and now wish to make amendments to it, you will need to cancel the Enduring Power of Attorney and create a new Lasting Power of Attorney instead.
If an Enduring Power of Attorney has been made and you subsequently lose mental capacity and therefore are unable to manage your financial affairs, the attorneys that you have appointed within the Enduring Power of Attorney will need to make an application to the Court of Protection to register the Enduring Power of Attorney before they can take over the managing of your affairs for you.
