Following the change in the Law in October 2007, new provisions have been introduced allowing the surviving spouse to leave not only their own nil rate band to their chosen relatives buy also any nil rate band unused on the first spouse’s death. This could mean that a surviving spouse can leave up to double the nil rate band at the date of their death, i.e. £325,000 x 2 (figures for 2010/2011).
